Website User Agreement

Your use of luxurytimerepairs.com (the “Website”) constitutes your agreement and acceptance with these Site Terms. These Site Terms may be changed periodically and updated Site Terms as they appear on the Website are effective immediately. We recommend you view these Site Terms when visiting the website as continued use of the Website after any such changes constitutes your consent to such changes.

Terms of Service Agreement

Luxury Time Repairs (“We”) is a service, wherein the customer (“You”) send us your watch requiring a service and/or repair, and we supply you an estimate which can then be accepted or declined. By using Luxury Time Repairs website and using the service, you agree to the terms and conditions (“T&C’s”) set forth herein. Additional T&C’s concerning the use of the site, privacy concerns and related to content or transactions are also posted in other areas of the site and, together with these Terms of Sale, oversee your use of those areas, content, or transactions. These terms, together with applicable additional T&C’s, are basis of a contractual agreement between Luxury Time Repairs and yourself and are referred to herein collectively as the “Agreement.”

1. Party Responsibility

Party Responsibility. Any and all transactions conducted on this site are only the responsibility of Luxury Time Repairs and such visitors.

2. Risk-Of-Loss

You remain responsible for the risk-of-loss for the products until delivery of the same to Watch Time Repairs. You are responsible for any damages that may occur to your product while in transit. Risk-of-Loss only passes to Luxury Time Repairs upon Luxury Time Repairs receipt of product. Receipt of watch occurs when box or envelope is signed for and inspected. This inspection process will be recorded by Luxury Time Repairs. In the event of a claim with the shipping company, you are responsible for providing proof of purchase as well as proof of shipment in order to collect on insurance. It is for this reason we highly recommend you retain the receipt of your shipping and take a photo of your watch once in the delivery box, but prior to securing it with self-adhesive tape. As a step further, but at the customer discretion, we recommend you video your watch placed in the box and the closure of the box by securing the self-adhesive strips. Please note, if you do not provide this proper documentation, Luxury Time Repairs is not responsible for obtaining insurance compensation. Furthermore, Luxury Time Repairs is not responsible for loss or damage during shipment or delivery. Luxury Time Repairs is the “shipper” only in name in order to facilitate the shipping process.

3. Insurance Cover

Shipping insurance does not cover sentimental value. During the inbound shipping (to our service centre), the watch is covered for its estimated replacement value minus cost of repair. On the outbound shipping, insurance covers the estimated replacement value of the watch only. Coverage is limited to the amount specified by Luxury Time Repair upon brand and model information provided by the customer and is also limited to the actual value of the watch.

4. Payment & Refund Policy

Upon proceeding with the “accept estimate” button and sending payment for the repair, you then have made a legally binding Agreement to proceed with the repair based on the quote received. If the Luxury Time Repairs ultimately considers the watch to actually be unrepairable after payment has been taken, a full refund minus return shipping (including insurance cost) is issued.

5. Repair of the watch will begin upon the receipt of payment

If there are other repair issues that are not defined by the customer, Luxury Time Repairs are not liable for identifying them – although we will endeavour to find any further issues ourselves upon inspection of the watch.

6. Repair Guarantee

Luxury Time Repairs does not make a guarantee that we can definitely repair your watch. Firstly, the watch must be examined to ascertain: a) can the repair be completed successfully? b) how much will the repair cost (inclusive of watchmaker’s time and parts)? Important to note, on occasion, the cost of the required repair could exceed the watch value.

7. If A Watch Is Deemed Unrepairable

If, at the discretion and judgement of Luxury Time Repairs, the watch cannot be effectively repaired due to either the availability of required parts or the labor, you agree to pay the return shipping (including insurance) for the watch.

8. Return (Inbound) Shipping

Luxury Time Repairs offers free incoming (to our facility) shipping only and on outbound shipments for watches repaired/serviced by Luxury Time Repairs. Please note, the Customer is responsible for the payment for return shipping for declined estimates. Luxury Time Repairs will organise return shipping for declined estimates once payment of $29 has been confirmed.

9. Abandoned Watch

Luxury Time Repairs is not responsible for watches left over nine (9) months.

10. Unwanted Watch

If you decide not to proceed with the repair work, and you do not want to pay for the shipping back to you, Luxury Time Repairs will retain your unrepaired watch for a period of no longer than nine (9) months in case you later decide to proceed with the repair or pay for the return shipment. After this period of time Luxury Time Repairs reserves the right to dispose of the watch.

11. Due to the intricacies of watch repair and the nature of sourcing the correct parts, Luxury Time Repairs make no guarantees in regard to the length of time required to fulfil the repair. We provide general guidelines based on our experience but please note these are simply estimates and are not tantamount to a guarantee of timing of a finished repair. Luxury Time Repairs are not responsible for any delays caused by the unavailability of parts or delays in part shipments by the supplier or manufacturer.

12. Brand Manufacturer Repairs

On occasion we may ask for your permission to ship your watch to the original brand manufacturer where the watch was made for further diagnostic. If permission is granted, there may be an extra charge to send the watch to the respective factory dependent on their own terms and conditions. The brand manufacturer will then provide a further estimate based on their diagnostic. The estimate should be consistent with the original estimate provided by Luxury Time Repairs, however Luxury Time Repairs are not responsible for the estimate provided by the brand manufacturer, nor any discrepancy from the original estimate. Please note, whilst at the brand manufacturer’s factory, Luxury Time Repairs is not responsible for any loss, damage, or any other issues associated with the repair. When the watch is in possession with the original brand manufacturer these terms and conditions will be superseded by the terms and conditions from the respective manufacturer/factory. We can provide further information from the manufacturer/factory upon request by contacting us at [email protected]. If the customer gives permission to send the watch to the brand manufacturer and then subsequently decides not to proceed with the watch repair after the watch has landed at the brand manufacturer, it becomes the customers responsibility to pay for return shipment to the Luxury Time Repairs service centre and then onto the original address provided by the customer.

13. Return Shipment

Although tracked, our shipping cannot guarantee the exact time of delivery. If you are not available to receive the delivery after several attempts are made, the package may be returned to us. If this occurs, you are responsible for further payment to re-ship the package back to you.

Luxury Time Repairs is not responsible for:

  • Any items which are delivered to an incorrect address which has been supplied by the customer.
  • Incomplete deliveries occurring due to the recipient not being present during the delivery at the address supplied by the customer;
  • Any delivery delays due to the fault of the shipping provider

14. Warranty

Luxury Time Repairs has one (1) year common-sense warranty which relates only to repair and servicing work actioned by us only. Please note, the warranty applies only to internal repairs performed on movement and components worked on during the repair. Partial repairs are not covered under our warranty. If a battery replacement does not solve the issue(s) further repair work may be needed at an extra cost. External and electric watch components (including but not limited to, crystal, band/bracelet, case, bezel and associated etc.) are not covered under Luxury Time Repair’s warranty. If the watch casing is ever opened within the one (1) year warranty period, the warranty will be cancelled. Furthermore, any water or damage from impact are not covered under the common-sense warranty. In regards to water damage, important to note that water-resistance is not considered a permanent condition as the components (gaskets) within the watch are at risk of deterioration over time and usage.

15. Accuracy of all Information

Luxury Time Repairs makes all efforts to ensure information sent by us and received the customer in relation to the customer’s product is accurate. If there are ever any technical errors, typographical errors, omissions or product pricing errors, Luxury Time Repairs does reserve the right to correct the error at the time of the discovery of said error. If Luxury Time Repairs corrects the error, Luxury Time Repairs will provide you with the following options: (1) you can proceed with the transaction based on the corrected information; or (2) to cancel your transaction, in which case Luxury Time Repairs will promptly return the product back to you.

16. General Provisions

a) Entire Agreement/No Waiver. These Terms of Service constitute the entire agreement of the parties with respect to the subject matter hereof. The captions are used only as a matter of convenience and are not to be considered a part of this agreement or be used in determining the intent of the parties to it. No waiver by Luxury Time Repairs of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

b) Correction of Errors and Inaccuracies.
The Content may contain typographical errors or other errors or inaccuracies and may not be complete or current. Luxury Time Repairs therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update the Content at any time without prior notice. Luxury Time Repairs does not, however, guarantee that any errors, inaccuracies, or omissions will be corrected.

c) Modification. Luxury Time Repairs reserves the right to modify this Agreement at any time without giving you prior notice. Your use of The Service following any such modification constitutes your agreement to follow and be bound by the Agreement as modified. The last date these Terms of Service were revised is set forth below. Terms and conditions modifying the Agreement are effective immediately upon posting.

d) THESE TERMS AND CONDITIONS ARE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH FLORIDA LAW, AND NO CONFLICT OF LAWS OR PROVISIONS OF ANY JURISDICTION WILL APPLY TO THESE TERMS AND CONDITIONS. BY CLICKING ON THE “ACCEPT” BUTTON BELOW, YOU AGREE THAT ANY ACTION AT LAW OR IN EQUITY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS WILL BE FILED ONLY IN STATE OR FEDERAL COURT LOCATED IN FLORIDA, AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURTS OVER ANY SUIT, ACTION, OR PROCEEDING ARISING OUT OF THESE TERMS AND CONDITIONS.
